It is a capital felony, punishable by life in prison or the death penalty. If the victim is between the ages of 12 and 15, lewd or lascivious molestation is a first-degree felony, punishable by up to 30 years in prison and a $10,000 fine.
  • Lewd or Lascivious Conduct: It is illegal to commit a lewd or lascivious act in the presence of a child under the age of 16. This can include touching yourself sexually, forcing a child to touch you sexually, or forcing a child to touch themselves sexually. Lewd or lascivious conduct is a second-degree felony.
  • Lewd or Lascivious Exhibition: Lewd or lascivious exhibition is a lewd or lascivious offense that involves exposing your sexual organs in a lewd or lascivious manner in the presence of a child under the age of 16. It is a third-degree felony.
