Types of Lewd or Lascivious Offenses in Florida

Under Florida law, lewd or lascivious offenses encompass a range of sexual crimes. These crimes are typically committed against children, but they can also involve adults. You can be charged with a lewd or lascivious offense even if you did not have sexual contact with the alleged victim.

The following are the different types of lewd or lascivious sex offenses as defined by Florida Statute ยง 800.04:

  • Lewd or Lascivious Battery: Lewd or lascivious battery is a lewd or lascivious offense that involves sexual activity with a child between the ages of 12 and 15. It is a second-degree felony, punishable by up to 15 years in prison and a $10,000 fine.
  • Lewd or Lascivious Molestation: Lewd or lascivious molestation is a lewd or lascivious offense that involves sexual activity with a child under the age of 12. It is a capital felony, punishable by life in prison or the death penalty. If the victim is between the ages of 12 and 15, lewd or lascivious molestation is a first-degree felony, punishable by up to 30 years in prison and a $10,000 fine.
  • Lewd or Lascivious Conduct: It is illegal to commit a lewd or lascivious act in the presence of a child under the age of 16. This can include touching yourself sexually, forcing a child to touch you sexually, or forcing a child to touch themselves sexually. Lewd or lascivious conduct is a second-degree felony.
  • Lewd or Lascivious Exhibition: Lewd or lascivious exhibition is a lewd or lascivious offense that involves exposing your sexual organs in a lewd or lascivious manner in the presence of a child under the age of 16. It is a third-degree felony.

Defending Against Lewd or Lascivious Crimes

Being charged with a lewd or lascivious offense does not mean you will be convicted. The prosecution has the burden of proving every element of the crime beyond a reasonable doubt. This is a high burden, and there are many defense strategies that can be effective in these cases.
